Terms of Service.

Welcome to Hans Photography Studio (“Studio,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern the use of our photography services, studio rental services, photography packages, add-ons, and online booking platform.

By making a booking, submitting a payment, uploading proof of payment, creating an account, or using our services, you acknowledge that you have read, understood, and agreed to these Terms.

Services

Hans Photography Studio provides photography-related services, which may include:

  • Studio photography sessions
  • Kiddie and family photography
  • Couple and portrait photography
  • Maternity and newborn photography
  • Graduation photography
  • Special photography sessions
  • Outdoor photography sessions
  • Studio room rental
  • Photography packages
  • Package add-ons and additional services

The specific services included in a booking are based on the package and add-ons selected by the customer at the time of booking.

Customer information

Customers are responsible for providing accurate and complete information when making a booking, including:

  • Full name
  • Contact information
  • Preferred booking date and time
  • Selected branch or studio room, when applicable
  • Selected photography package
  • Number of participants, when applicable
  • Other information reasonably required to complete the booking

Hans Photography Studio is not responsible for problems caused by incorrect or incomplete information provided by the customer. Customers must promptly inform the Studio if any booking information needs to be corrected.

Booking and reservation

A booking request submitted through the website does not automatically guarantee a reservation unless the booking has been confirmed by Hans Photography Studio.

A reservation may require payment of a required down payment. A booking is considered confirmed only after the customer submits the required information, pays the required down payment, submits proof of payment when required, and the Studio verifies and confirms the payment and booking.

The Studio reserves the right to decline or cancel a booking if the information provided is inaccurate, the selected schedule is unavailable, or the payment cannot be verified.

Down payment, cancellation, and refund policy

A down payment is required for certain photography packages and studio rental bookings to secure the customer’s selected date and time. The down payment will be credited toward the customer’s total booking amount.

4.1 Cancellation before the scheduled date

Customers who cancel a confirmed booking at any time before the scheduled appointment date are eligible for a 50% refund of the amount they have paid. This 50% refund policy applies regardless of how many days in advance the cancellation is made.

For example: a cancellation made 7 days before the appointment, 3 days before the appointment, or 1 day before the appointment will each be subject to a 50% refund of the amount paid.

The remaining 50% will be retained by Hans Photography Studio to compensate for the reservation of the scheduled time, staff, studio facilities, and other resources allocated to the booking.

4.2 Same-day cancellation

If the customer cancels on the scheduled appointment date, the customer is not eligible for a refund, unless the Studio determines that exceptional circumstances or a valid reason warrant an alternative arrangement.

4.3 No-show

The customer’s down payment will be forfeited if the customer fails to attend the scheduled appointment without providing prior notice or a valid reason.

A no-show means that the customer does not appear for the scheduled booking and has not informed Hans Photography Studio beforehand that they are unable to attend.

4.4 No-show with a valid reason

If the customer is unable to attend because of a valid or reasonable circumstance, the customer should notify Hans Photography Studio as soon as reasonably possible. The Studio may evaluate the circumstances on a case-by-case basis and may, at its discretion, allow the customer to reschedule the booking or provide another reasonable arrangement.

Approval of a rescheduling request is not automatic and is subject to Studio availability.

4.5 Refund processing

Approved refunds will be processed according to the Studio’s applicable refund procedure. The customer may be required to provide accurate information necessary for processing the refund.

4.6 Cancellation and refund summary

Payment

Hans Photography Studio may accept payment through the payment methods made available by the Studio, including GCash or other payment methods that may be introduced in the future.

For manual payments, the customer must send the required amount to the official payment account provided by the Studio, submit valid proof of payment, and wait for verification. The booking will be confirmed after successful verification.

Customers should only make payments using the official payment details displayed or communicated by Hans Photography Studio. The Studio is not responsible for payments sent to unauthorized accounts or individuals.

Payment verification

Payment proof submitted by customers must be genuine, readable, and correspond to the booking being paid for.

The Studio reserves the right to reject payment proof that appears altered, edited, incomplete, unreadable, duplicated, inconsistent with the stated payment amount, or not associated with the customer’s booking.

Any suspected fraudulent payment activity may result in cancellation of the booking and may be handled in accordance with applicable law.

Booking date and time

Customers are expected to arrive on time for their scheduled session. Customers should arrive at least 15 minutes before the scheduled session to allow sufficient time for preparation.

The photography session will generally begin and end according to the confirmed booking schedule.

Late arrival may reduce the customer’s available photography time if another booking follows the customer’s scheduled appointment. The Studio is not required to extend the session beyond the original booking period because of the customer’s late arrival.

Rescheduling

Customers who need to change their booking date or time must contact Hans Photography Studio as soon as possible.

Rescheduling requests are subject to Studio availability, availability of photographers and staff, and availability of the selected package or studio room.

A rescheduling request does not automatically guarantee the requested new date or time.

Customers who cannot attend their appointment are encouraged to contact the Studio before the scheduled date rather than simply failing to attend.

No-show policy

A customer who fails to attend their scheduled appointment without prior notice or a valid reason will be considered a no-show. In such cases, the down payment will be forfeited and the booking may be canceled.

The Studio may consider exceptional circumstances on a case-by-case basis when the customer provides a valid reason.

Package inclusions

Each photography package has specific inclusions, which may include:

  • Number of poses
  • Number of participants
  • Session duration
  • Number or type of edited photographs
  • Printing services
  • Digital copies
  • Props or accessories
  • Studio use
  • Other services listed in the package description

Customers are encouraged to review package details carefully before confirming their booking. Requests for services outside the package may be subject to additional charges.

Additional services and add-ons

Additional services or products requested by the customer that are not included in the original package may incur additional charges.

The customer will be informed of the applicable additional charge before the service is provided whenever reasonably possible.

Studio rental

For customers renting a studio room, the rental is limited to the date, time, room, and duration specified in the confirmed booking.

Customers must use the studio and its equipment responsibly. Customers may be charged for damage caused by intentional, negligent, or improper use of Studio property, subject to applicable law and reasonable assessment of the damage.

The Studio reserves the right to require customers to stop using equipment or facilities when continued use presents a safety risk.

Studio rules

Customers and their guests must:

  • Follow reasonable instructions from Studio personnel.
  • Treat Studio property and equipment with care.
  • Keep the Studio reasonably clean.
  • Avoid behavior that may endanger people or property.
  • Avoid unauthorized use of equipment.
  • Respect other customers and Studio personnel.

The Studio may refuse service or end a session when a person’s behavior creates a serious safety risk, causes significant property damage, or substantially interferes with Studio operations.

Number of participants

The number of participants allowed in a photography session may depend on the selected package or studio room.

Customers should inform the Studio in advance if additional participants will attend. Additional participants may be subject to additional charges or Studio limitations.

The Studio reserves the right to limit the number of participants when necessary for safety, space, or service-quality reasons.

Children and minors

Parents, guardians, or accompanying adults are responsible for supervising children and minors during their visit to the Studio.

The Studio and its personnel should not be considered the sole supervisors or guardians of minors.

Parents or legal guardians are responsible for informing the Studio of any relevant instructions or precautions concerning the child.

Photography and editing

Photography results may vary depending on factors including lighting conditions, location, subject positioning, clothing, makeup and styling, customer cooperation, weather conditions for outdoor sessions, and other circumstances affecting the photography session.

The Studio will make reasonable efforts to produce photographs consistent with its professional style and the selected package.

Editing may include color correction, exposure adjustment, cropping, retouching, and other standard post-processing techniques depending on the selected package.

Extensive or special editing requests may require an additional fee.

Delivery of photographs

Estimated delivery time for edited photographs: 2–3 days.

Delivery times may vary depending on the number of customers, workload, complexity of editing, equipment issues, holidays, and other circumstances.

Customers must provide accurate contact or delivery information where necessary. The Studio is not responsible for delays caused by incorrect information provided by the customer.

Photo selection

Where applicable, customers may be required to select photographs for editing. Customers must complete their selections within the period specified by the Studio.

Failure to submit selections within the specified period may delay the delivery of the final photographs.

Copyright and ownership

Unless otherwise agreed in writing, photographs created by Hans Photography Studio remain subject to the Studio’s and/or photographer’s applicable copyright and intellectual property rights.

Customers receive permission to use the delivered photographs for personal purposes, subject to any restrictions communicated by the Studio.

Customers may not commercially sell, license, redistribute, or substantially modify the photographs without appropriate permission from the copyright owner, unless otherwise permitted by applicable law or written agreement.

Where applicable, commercial usage may require a separate agreement or licensing fee.

Studio portfolio and promotional use

Hans Photography Studio may wish to use photographs from photography sessions for its portfolio, website, social media, advertising, promotional materials, and sample galleries.

Where required, the Studio will obtain the customer’s appropriate consent before using identifiable photographs for promotional purposes.

Customer preference may be recorded as follows:

  • I agree that photographs from my session may be used by Hans Photography Studio for portfolio, promotional, advertising, and social media purposes.
  • I do not agree to promotional use of photographs in which I or the individuals I represent are identifiable.

Customer-provided materials

If customers provide photographs, designs, logos, props, costumes, or other materials to the Studio, the customer represents that they have the necessary rights or permission to provide and use those materials.

The Studio is not responsible for copyright or intellectual property violations arising from materials supplied by the customer.

Personal information and privacy

Hans Photography Studio may collect and process personal information necessary to process bookings, confirm appointments, verify payments, communicate with customers, provide photography services, maintain booking and transaction records, improve Studio services, and fulfill other legitimate business purposes.

Personal information will be handled in accordance with applicable Philippine privacy laws and the Studio’s Privacy Policy.

Customers should review the Studio’s Privacy Policy for additional information regarding the collection, use, storage, and protection of personal information.

Customer responsibility

Customers are responsible for ensuring that the information they provide to the Studio is accurate.

Customers are also responsible for arriving on time, following Studio rules, supervising accompanying minors, taking care of personal belongings, following reasonable safety instructions, and paying applicable fees and charges.

Personal belongings

Customers are responsible for their personal belongings while inside the Studio.

Hans Photography Studio will take reasonable measures to maintain a safe environment but is not responsible for loss, theft, or damage to personal belongings except where liability cannot lawfully be excluded.

Customers should avoid bringing unnecessary valuables to their session.

Liability

Hans Photography Studio will exercise reasonable care in providing its services.

To the extent permitted by applicable law, the Studio will not be responsible for losses arising from circumstances beyond its reasonable control.

Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law.

Force majeure

The Studio will not be considered in breach of these Terms when it is unable to perform its obligations because of circumstances beyond its reasonable control, including but not limited to:

  • Natural disasters
  • Severe weather
  • Fire
  • Power interruptions
  • Government restrictions
  • Public emergencies
  • Equipment failure
  • Serious illness or emergency involving essential personnel
  • Other unforeseeable events beyond reasonable control

The Studio will make reasonable efforts to notify affected customers and, where practical, provide a rescheduled booking or other appropriate solution.

Changes to services and prices

Hans Photography Studio reserves the right to modify its photography packages, prices, add-ons, studio rental rates, operating policies, and services.

Changes will generally apply to future bookings and will not retroactively alter confirmed bookings unless otherwise agreed or required by law.

Terms of Service modifications

Hans Photography Studio may update these Terms from time to time. Updated Terms will be posted through the Studio’s website or otherwise made available to customers.

The Terms applicable to a confirmed booking will generally be those accepted by the customer at the time of booking, subject to applicable law and any mutually agreed changes.

Customer acceptance

By submitting a booking through the Hans Photography Studio website, the customer confirms that:

  • They have read these Terms of Service.
  • They understand the booking, payment, cancellation, refund, rescheduling, and no-show policies.
  • The information they provided is accurate and complete.
  • They agree to comply with Studio rules.
  • They agree to be bound by these Terms to the extent permitted by applicable law.

For bookings involving a minor, the parent or legal guardian should provide the required consent on behalf of the minor where applicable.

Governing law

These Terms shall be interpreted and governed in accordance with the applicable laws of the Republic of the Philippines.

Any dispute arising from or relating to these Terms or the Studio’s services shall be addressed in accordance with applicable Philippine laws and regulations.
